1. Scope

1.1 The following General Terms and Conditions govern current and future business and contractual relations between , an offer by Alan Sturge-Rocha, Zossener Straße 26, 10961 Berlin – hereinafter referred to as “Juggling Academy” – and participants in individual and group workshops organised by Juggling Academy, hereinafter referred to as customer.

1.2 Deviating or supplementary terms and conditions of the customer do not become part of the contract, unless Juggling Academy expressly agrees to their validity. Ancillary agreements, amendments or additions require the textual form to be effective, as does the removal of the requirement of the text form itself.

  1. Offer, Booking, Order Confirmation

2.1 Individual and Group Workshops

“Individual and group workshops” are training events that are organized online via WhatsApp or Telegram. Juggling Academy provides the workshop leader, the course material (digital content) and a certificate of participation. Workshops are held in six consecutive weekly sessions. At the beginning of a weekly session, the customer receives digital learning content via WhatsApp or Telegram. The customer has three days to train following the instructions and then provides a self-recording video of his skills. The workshop leader then gives feedback and further assistance once by means of text, video or voice message. Per weekly unit, the customer can ask a maximum of two in-depth questions by means of text, video or voice message, which are answered by the workshop leader within the weekly session. In group workshops, the customer’s video self-recordings and correspondence with the teacher are available for all workshop participants.

2.2 Registrations for workshops are made online on  juggling-academy.com. The number of participants in group workshops is limited to a maximum of 15 participants. The purchase contract for participation in a workshop will only become legally effective if it is confirmed by Juggling Academy in written. The booking of a workshop is binding for the customer.

2.3 In case of participation in courses that are expressly not suitable for absolute newcomers to the discipline taught, a video self-recording of the customer’s prior knowledge is required. The customer has to provide this to the workshop leader before the course starts. Juggling Academy reserves the right to divide customers into learning groups based on their video self-recording.

  1. Workshop Fees, Payment Terms

3.1 Individual and Group Workshops

The workshop fee includes the costs of the booked workshop and the course material. The customer will provide the juggling equipment necessary for successful participation in the respective workshop.

By clicking on the button “Place order” in the last step of the ordering process on juggling-academy.com, the customer places a legally binding order of the workshops contained in the shopping cart. The purchase contract is concluded when Juggling Academy accepts the order by an order confirmation by e-mail.

  1. 14 Days Money Back Guarantee

Juggling Academy offers the customer a 100% money back guarantee if the customer is not satisfied with the booked workshop. The warranty is valid for 14 days from the start of the workshop. A brief written notice and a statement of reasons for the refund (e.g. by e-mail) are sufficient to claim the refund. Should the customer claim the warranty, Juggling Academy will refund the workshop fee immediately and no later than fourteen days from receipt of the notification. For the refund, Juggling Academy uses the same means of payment used in the original transaction. Under no circumstances does Juggling Academy charge for this repayment.

  1. Right of Withdrawal for Consumers in the Case of Distance Contracts

Consumers are entitled to a statutory right of withdrawal in the case of distance contracts (contracts in which the trader or a person acting on his behalf or behalf and the consumer use only distance communication for the negotiation of contracts and the conclusion of the contract). A consumer within the meaning of Paragraph 13 of the German Civil Code (BGB) is any natural person who concludes a legal transaction for purposes which cannot be attributed primarily to his commercial or independent professional activity.

Withdrawal

You have the right to withdraw from this contract within fourteen days without giving reasons.

Withdrawal period

The withdrawal period for services (e.g. workshops) is fourteen days from the date of conclusion of the contract.

In order to exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. e-mail). You can use the attached model withdrawal form, but this is not mandatory. This sample withdrawal form can be downloaded here.

In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of Revocation

If you withdraw from this contract, we shall refund to you all payments received from you immediately and at the latest within fourteen days from the day on which we receive notification of your revocation of this contract. For the refund, Juggling Academy uses the same means of payment used in the original transaction. In no case will you be charged any fees for this repayment.

  1. General Provisions

6.1 Offers, deliveries and services of Juggling Academy are made exclusively with the inclusion of these General Terms and Conditions. Changes shall only apply to the extent that they have been agreed in text form.

6.2 The workshop offer of Juggling Academy is non-binding. This applies in particular to price information. The purpose of the respective contract is the execution of the booked workshop, but not a certain success.

6.3 The workshops are held exclusively on behalf of Juggling Academy. If the customer is interested in additional and/or follow-up trainings with the teachers appointed, the booking must be made via Juggling Academy as well as new orders.

6.4 It is only possible to receive a certificate of participation if a participant has visited the entire event and has carried out the weekly tasks. A workshop cannot be distributed among multiple participants. A partial booking with price reduction is not possible in principle.

6.5 Juggling Academy is entitled to pass on parts of an order to third parties by means of under-authorisation, even without the consent of the customer.

  1. Liability

7.1 Juggling Academy, as the organiser, is only liable for personal injury and property damage in the event of intent or gross negligence on the part of Juggling Academy or its vicarious agents. This applies in particular to practical exercises of the customer. The customer has to choose a suitable location for the execution of the training sessions of the respective discipline.

7.2 Insurance claims in the event of accidents and damages caused by the customer cannot be asserted against Juggling Academy as organiser. Juggling Academy does not provide insurance cover for the customer’s introduced juggling equipment. The customer is obliged to take out the usual insurance against direct or indirect damages.

  1. Workshop Contents

The workshop events are carefully and conscientiously prepared and conducted. Juggling Academy assumes no liability for the topicality, correctness and completeness of the workshop teaching content or the conduct of the workshops.

  1. Workshop, Cancellation/Change of Events

9.1 All workshops correspond to the scope and content stipulated in the individual offer, subject to necessary changes of organisational or content, insofar as these do not significantly change the overall character of the event. If necessary, Juggling Academy can replace the initially planned workshop leader with equally qualified persons. The customer is not entitled to the selection of a specific workshop leader. In the workshops offered, the customer determines the place where he internalizes the teaching content and trains at his own discretion. There is no online attendance requirement or live event, Juggling Academy only provides time frames for training the teaching content. If the customer fails to complete the workshop or individual weekly units, he is not entitled to late submission of the video self-recording of missed weekly units or recourse against Juggling Academy.

9.2 Juggling Academy is entitled to change, postpone or cancel Workshops, or to have the workshop leader represented, for reasons for which it is not responsible, in particular in the event of a lack of a reasonable number of participants or in case of illness of the workshop leader. In that case the customer will be notified immediately in text form. In the event of illness of the speaker/seminar leader without the possibility of providing a replacement in good time, Juggling Academy has the right to postpone the seminar until a replacement date. If a seminar fails without replacement, workshop fees will be refunded to the customer. The customer has no further claims against Juggling Academy, in particular for damages.

  1. Copyrights

10.1 Juggling Academy expressly reserves the copyright to the learning content and video guides created by it or by the workshop leaders. Digital workshop teaching content or parts thereof may not be reproduced, made available to third parties privately or publicly, without the written consent of Juggling Academy. The complete rights of use of the video self-recordings made by the customer before and within the scope of the workshop participation shall be transferred to Juggling Academy from the moment of the customer’s provision. In particular, Juggling Academy reserves the right to use these videos for advertising purposes.

10.2 Without written express consent of Juggling Academy, with the exception of certificates issued by Juggling Academy, the word and figurative trade mark of the Juggling Academy may not be used for further use (e.g. advertising on a homepage).

  1. Data Protection

11.1 The customer’s data is processed electronically for internal purposes. The data associated with the registration will be stored in compliance with the data protection regulations (GDPR).

11.2 The customer’s name, address, telecommunications data and e-mail address are required to process the order. The personal data will be used by Juggling Academy exclusively for the purpose of fulfilling the contract. The customer can receive information about the data stored by him at any time. The Juggling Academy treats this information confidentially and does not pass it on to third parties, except to partner companies that need the data to process the order. In addition, reference is made to our Privacy Policy.

  1. Other

12.1 Should some of these provisions be ineffective or subsequently become ineffective, this shall not affect the validity of these provisions in its entirety.

12.2 If the customer is a full merchant or a person under public law or if the customer has no permanent residence in Germany, the place of jurisdiction for disputes arising out of or in connection with this contract is the district court of Berlin Tempelhof-Kreuzberg or the district court of Berlin Kreuzberg.

12.3 Place of execution is Berlin.

12.4 Juggling Academy does not participate in a dispute resolution procedure before a consumer arbitration board.

12.5 The law of the Federal Republic of Germany applies exclusively to the exclusion of the UN Convention on Contracts for the Sale of Goods.

12.6 Ancillary agreements, amendments or additions must be effective, as well as the cancellation of the written requirement, in written form.
